User Terms of Service

For all individuals who create an account and use FeedMarch

1Agreement to These Terms

Welcome to FeedMarch. By creating an account, clicking “Create Account”, signing in via magic link, or otherwise accessing or using FeedMarch, you agree to be bound by these User Terms of Service (“Terms”). If you do not agree, you must not create an account or use the platform.

These Terms form a legally binding contract between you and SparkIntell Inc, doing business as FeedMarch (“FeedMarch”, “we”, “us”, or “our”). Please read them carefully.

Beta service: FeedMarch is currently offered as a beta service. Features may change, be added, or be removed, and the platform is provided “as is” without warranties of any kind. We may modify or discontinue any part of the service during the beta period as we refine the product based on your feedback.

Notice: You must be at least 18 years of age to create an account. By agreeing to these Terms, you represent that you are 18 or older.

2What FeedMarch Is

FeedMarch is a public, democratic feedback marketplace where verified users can post wishes, vote, and comment about any product, app, or service. FeedMarch is a neutral platform. We are not affiliated with, endorsed by, or responsible for any company, product, or brand listed on or discussed within the platform.

FeedMarch is not the publisher or speaker of any user-generated content posted on this platform. FeedMarch expressly disclaims all liability arising from user-generated content to the fullest extent permitted by applicable law, including Section 230 of the Communications Decency Act.

Product pages on FeedMarch may be created automatically when users submit wishes about a product not yet listed. The existence of a product page does not constitute affiliation, partnership, sponsorship, or endorsement. Companies wishing to claim or dispute their product page may contact us at legal@feedmarch.com.

3Account Registration & Verification

3.1 One Person, One Account

You may only create one FeedMarch account. Accounts are personal and non-transferable. Creating multiple accounts for any purpose, including to cast additional votes, is prohibited and constitutes a material breach of these Terms.

3.2 Email Verification Required

All accounts must be verified via a valid email address before you may post a wish, vote, comment, or interact with any content. We reserve the right to verify your identity at any time using additional means.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account, and to keep that information updated.

3.4 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at security@feedmarch.com if you suspect unauthorized access.

4What You Can Do on FeedMarch

As a verified user, you may:

  • Post wishes about any product, app, service, or brand
  • Vote on other users' wishes (one vote per wish; you may not vote on your own wish)
  • Comment on wish threads
  • Click "I want this too" to signal solidarity with an existing wish
  • Share wishes via the share function
  • Toggle whether your wish displays publicly under your username or as anonymous
  • Follow products to receive updates

5What You Cannot Do on FeedMarch

  • Create multiple accounts or use any means to cast more than one vote per wish
  • Vote on your own wishes
  • Post content that is false, defamatory, fraudulent, or misleading
  • Post content that infringes any third party's intellectual property rights
  • Post any content that is hateful, harassing, violent, pornographic, or exploitative
  • Upload malware, viruses, or any harmful code
  • Use automated bots, scripts, or tools to interact with FeedMarch
  • Impersonate another person, company, or FeedMarch itself
  • Attempt to manipulate trending scores, voice counts, or platform rankings
  • Attempt to reverse-engineer, scrape, or copy the platform's data or code
  • Use FeedMarch to promote competing platforms or services
  • Create wishes or vote on behalf of a company or brand about their own products

6Your Content: What You Own & What You License

6.1 You Own Your Wishes

You retain full copyright ownership of the wishes, comments, and other content you submit to FeedMarch (“Your Content”). FeedMarch does not claim ownership of Your Content.

6.2 The License You Grant Us

By submitting content to FeedMarch, you grant SparkIntell Inc a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to display, process, aggregate, and use Your Content as described below:

  • Display Your Content publicly on the FeedMarch platform
  • Process Your Content through AI systems for duplicate detection, moderation, and quality control
  • Aggregate and anonymize Your Content into analytical insights and intelligence reports
  • Use aggregated, anonymized data in our commercial products, including paid company analytics
  • Reproduce Your Content for backup, archival, and legal compliance purposes
  • Use Your Content to improve and train FeedMarch's AI-powered features

Important: The license above does not allow FeedMarch to sell Your Content individually, identify you personally in any commercial report without your consent, or transfer ownership of Your Content to any third party.

6.3 Anonymous Display

You may choose to post wishes anonymously. Anonymous display means your username will not appear publicly. However, FeedMarch retains verified identity records for all accounts. Anonymous display does not mean truly anonymous identity. We may be legally required to disclose identity information in response to valid legal process.

6.4 Content You Remove

If you delete Your Content, we will make reasonable efforts to remove it from public display. Aggregated data derived from Your Content already incorporated into anonymized analytics cannot be retroactively removed.

7Authenticity & Voting Integrity

You agree that every vote you cast represents a genuine, individual opinion. You will not coordinate with others to artificially inflate or deflate voice counts, accept payment in exchange for posting or voting, or create fake personas to engage with content on the platform.

Authenticity Guarantee: Every wish on FeedMarch comes from a verified human. One person. One voice. One vote.

7.1 FeedMarch Vote & Metrics Control

FeedMarch reserves the right, at its sole discretion, to monitor, adjust, remove, invalidate, or reclassify any votes, rankings, engagement metrics, trending scores, or other platform signals where such activity is determined to be artificial, manipulative, or otherwise inconsistent with platform integrity.

8Moderation & Content Removal

8.1 FeedMarch's Moderation Rights

FeedMarch reserves the right, but not the obligation, to review, remove, hide, or modify any content at any time, for any reason, at our sole discretion, without notice or liability to you.

8.2 AI-Assisted Moderation

FeedMarch uses automated AI tools to screen all submitted content for policy violations before publication. By submitting content, you consent to this automated processing.

8.3 Shadow Banning

If your account repeatedly triggers moderation filters, we may implement “shadow banning”: your posts will appear visible to you but will not be shown to other users.

8.4 Account Termination

We may suspend or permanently terminate your account for any violation of these Terms. Provisions that by their nature should survive termination will survive.

8.5 Email Communications

Users may opt out of promotional communications at any time. However, transactional communications (account verification, security alerts, password resets, billing notifications, and legal notices) cannot be fully opted out of while maintaining an active account.

9DMCA & Intellectual Property

FeedMarch claims protection under the safe harbor provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512). FeedMarch has designated a registered DMCA agent with the U.S. Copyright Office.

9.1 Repeat Infringer Policy

FeedMarch maintains a policy of terminating, in appropriate circumstances, accounts of users who are determined to be repeat infringers of intellectual property rights.

9.2 DMCA Takedown Notices

Your notice must include: (1) identification of the copyrighted work; (2) URL of the infringing content; (3) your contact information; (4) a good-faith statement; (5) a statement under penalty of perjury; and (6) your signature.

9.3 Counter-Notification

If you believe content was removed in error, submit a written counter-notification to dmca@feedmarch.com. FeedMarch may restore the content in accordance with DMCA procedures.

10Disclaimer of Warranties

FEEDMARCH IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. WE MAY CHANGE, SUSPEND, OR DISCONTINUE ANY ASPECT OF FEEDMARCH AT ANY TIME WITHOUT NOTICE.

11Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPARKINTELL INC (DBA FEEDMARCH) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED US DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY.

12Indemnification

You agree to defend, indemnify, and hold harmless SparkIntell Inc (doing business as FeedMarch) from any claims, liabilities, damages, losses, and expenses arising out of or relating to: (a) your violation of these Terms; (b) Your Content; (c) your use of FeedMarch; or (d) your violation of any third party's rights.

13Dispute Resolution & Arbitration

Please read carefully. This section affects your legal rights.

13.1 Mandatory Arbitration

Any dispute arising out of or relating to these Terms or your use of FeedMarch shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

13.2 Class Action Waiver

YOU AND FEEDMARCH EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13.3 Exceptions

Either party may seek injunctive or emergency relief in a court of competent jurisdiction. You may also bring claims in small claims court if your claims qualify.

13.4 Governing Law & Venue

These Terms shall be governed by the laws of the State of Texas. For matters not subject to arbitration, you agree to the exclusive jurisdiction of state and federal courts in Texas.

14Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you via email or a prominent in-platform notice. Your continued use of FeedMarch after the effective date constitutes your acceptance of the changes.
