Company Terms of Service

For companies, brands, and organizations that enroll on FeedMarch

1Agreement to These Terms

By clicking “Enroll Your Company”, “Get Started for Free”, or by accessing any company-facing features of FeedMarch, the individual doing so represents that they have authority to bind their organization (“Company”, “you”, or “your”) to these Company Terms of Service (“Company Terms”).

These Company Terms, together with your selected subscription tier and any applicable Order Form, form the complete agreement between your Company and SparkIntell Inc, doing business as FeedMarch. If you do not have authority to bind your organization, or if you do not agree to these Company Terms, do not enroll.

2What FeedMarch Provides to Companies

FeedMarch provides companies with tools to monitor, respond to, and analyze user-generated feedback about their products. Depending on your subscription tier, this may include:

  • A claimed product page where you can respond officially to user wishes
  • Analytics dashboard showing trending wishes, voice counts, and feedback categories
  • AI-powered insight summaries of aggregated user feedback
  • Status update tools (e.g., mark wishes as "In Progress" or "Shipped")
  • Competitor benchmarking and industry trend data (Enterprise tier)
  • Priority support and featured placement (Enterprise tier)

Critical Distinction: FeedMarch provides access to aggregated intelligence derived from user feedback. FeedMarch does not sell or transfer ownership of any individual user's content. The raw wishes belong to the users who posted them. The processed intelligence belongs to FeedMarch.

3Enrollment, Accounts & Claiming Products

3.1 Company Account

Company accounts are separate from user accounts. The individual who enrolls becomes the account administrator. You may add team members to your company account depending on your tier.

3.2 Claiming Your Product Page

Enrollment allows you to claim ownership of product pages on FeedMarch that relate to your company's products. Claiming a product page does not remove or alter any user-generated wishes or votes; it only gives you the ability to respond officially and access analytics.

3.3 Unauthorized Claims

You may only claim product pages for products owned or operated by your Company. Claiming a competitor's product page, or making false representations about your identity, is grounds for immediate account termination and may expose you to legal liability.

During beta, only Free and Pro are self-serve via the enrollment flow. Business, Enterprise, and Category Intelligence are sales-led with custom pricing; contact sales@feedmarch.com or refer to your Order Form. Current self-serve pricing is published at /pricing and prevails over this summary.

4.2 Billing & Auto-Renewal

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. We will notify you by email at least 7 days before any renewal.

4.3 Refund Policy

Annual subscriptions may be refunded on a pro-rata basis within 14 days of the initial purchase or annual renewal date. Monthly subscriptions are non-refundable after the billing date. No refunds are issued for partial months.

4.4 Price Changes

We may change subscription pricing with at least 30 days' written notice to your registered email. Price changes take effect at your next renewal. If you do not agree to the new pricing, you may cancel before renewal.

5Company Conduct Rules: The Non-Negotiables

Platform Integrity Rule: FeedMarch's value is built on authentic user voices. Any attempt to undermine that authenticity is a fundamental breach of this agreement.

5.1 No Suppression of Authentic Feedback

Companies may NEVER use their FeedMarch access to remove, hide, suppress, or manipulate legitimate user-generated wishes or votes. This prohibition is absolute. Any attempt to do so will result in immediate account termination with no refund.

5.2 No Fake Users or Coordinated Inauthentic Behavior

Companies may NOT create or use fake user accounts, instruct employees or contractors to post wishes about their own products without clear disclosure, organize customers to artificially inflate voice counts, or pay or incentivize users to post or vote in any particular way.

5.3 Accurate Official Responses

When you post an “Official Response” to a wish, that response must be accurate, honest, and genuinely representative of your company's position. You may not post Official Responses that are misleading, deceptive, or that misrepresent your product's capabilities or roadmap.

5.4 Accurate Status Badges

If your tier includes the ability to update wish status badges (“In Progress”, “Shipped”, “Declined”), you must update these badges accurately and in good faith.

5.5 No Defamatory or Illegal Use

You may not use FeedMarch, including your Official Response capability, to defame, harass, or make false statements about competitors, users, or third parties.

6Company Content: Ownership & License

6.1 You Own Your Official Responses

Your Company retains copyright ownership of any official responses, statements, or other content you post through your company account (“Company Content”).

6.2 The License You Grant Us

By posting Company Content, you grant SparkIntell Inc a worldwide, non-exclusive, royalty-free license to display, distribute, and make your Company Content publicly accessible on FeedMarch. This license ends when you delete the content, subject to reasonable archival periods.

6.3 FeedMarch's Proprietary Analytics

The analytics, insights, trend reports, and AI-processed intelligence that FeedMarch generates from user feedback data are proprietary to FeedMarch. Your subscription gives you a limited, non-transferable license to access and use this intelligence internally. You may not resell, redistribute, or sublicense FeedMarch analytics to third parties.

6.4 Data on Cancellation

Upon cancellation of a paid subscription, you retain the right to export your company's Official Response history and dashboard data for a period of 30 days after cancellation. After 30 days, this data may be deleted. Analytics data generated by FeedMarch is not exportable and remains FeedMarch's property.

7Disclaimer of Warranties

FEEDMARCH IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ALL USER FEEDBACK IS ACCURATE OR GENUINE, OR THAT INSIGHTS DERIVED FROM USER FEEDBACK WILL PRODUCE ANY PARTICULAR BUSINESS RESULT. COMPANIES USE FEEDMARCH DATA, ANALYTICS, INSIGHTS, AND PLATFORM INTELLIGENCE ENTIRELY AT THEIR OWN RISK. NO DECISION SHOULD BE MADE SOLELY ON THE BASIS OF FEEDMARCH ANALYTICS WITHOUT INDEPENDENT VERIFICATION.

8Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPARKINTELL INC'S (DBA FEEDMARCH) TOTAL LIABILITY TO YOUR COMPANY FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE COMPANY TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOUR COMPANY TO FEEDMARCH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL FEEDMARCH BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9Indemnification

Your Company agrees to indemnify, defend, and hold harmless SparkIntell Inc (doing business as FeedMarch) from any claims, damages, or expenses arising from: (a) your violation of these Company Terms; (b) your Company Content; (c) your use of FeedMarch in violation of applicable law; or (d) any dispute between you and a FeedMarch user.

10Confidentiality

Each party agrees to keep confidential any non-public information of the other party that is designated as confidential or that reasonably should be understood to be confidential. This obligation does not apply to information that is publicly available, was already known, or is required to be disclosed by law.

11Dispute Resolution

Disputes under these Company Terms shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules, with arbitration seated in Texas. Class action and collective arbitration are waived. Governing law is the State of Texas.

12Term & Termination

These Company Terms remain in effect for as long as you maintain a FeedMarch company account. Either party may terminate for convenience with 30 days' written notice. FeedMarch may terminate immediately for material breach, including any violation of Section 5 (Company Conduct Rules).
